Eligibility for VA Benefits - Aid and Attendance

Eligibility is based upon dates of service, discharge status, and need for care. 


Basically these are:

1. Wartime Veteran - must have served one day during a period of war, with at least a total of 90 days of active duty.

Dates which are considered "periods of war": (need one day of active service during this time)

  • World War I: April 6, 1917, through November 11, 1918
  • World War II: December 7, 1941, through December 31, 1946
  • Korean War: June 27, 1950, through January 31, 1955
  • Vietnam War: August 5, 1964 (February 28, 1961, for veterans who served "in country" before August 5, 1964), through May 7, 1975
  • Persian Gulf War: August 2, 1990, through a date to be set by Presidential Proclamation or Law.

2. Must have received any discharge status other than dishonorable.  

3. Must now need the assistance of another individual to assist you with at least one activity of daily living*.

Qualifications for VA Benefits - Aid and Attendance

If you meet the eligibility requirements (see our post on the eligibility requirements by clicking here), you must then meet the qualification standards.

These standards are based upon income, the cost of care that is needed, and the amount of savings and investments that you have accumulated. There is no set standard for qualification. Each case must be evaluated on it's own to determine whether or not a veteran or spouse will qualify.

Unlike other governmental benefits, the Aid and Attendance program does not currently penalize individuals for making adjustments to help them qualify.

This means that knowing whether you qualify or not, can only be done by speaking with an expert. Just like when one files taxes at the end of the year, one generally does not simply go to the IRS and give them their paperwork and information. We understand that by going to a tax expert - an accountant, he or she will be able to save a significant amount of money or get back a larger refund, using allowances, exemptions, and other tools that are available to each person based on their individual situation.

Benefits with the VA is no different. An expert can get you a lot more generally than one would otherwise get, by having a deep understanding of the VA benefits, and knowing how to apply them to an individual case.
